UPDATE: The unnamed passenger who fell off a Atlantis gay cruise “intentionally went overboard,” reports The Sun UK.

Representatives from Royal Caribbean International say a review of CCTV tapes indicate the man, who has been reported to be British, did not fall accidentally over the railing and was not pushed.

The 30-year-old passenger plunged from his balcony on deck 11 of luxury liner Allure of the Seas in waters off Mexico… The ship made multiple public announcements and began a complete search of the ship, in efforts to locate the guest. When the guest did not respond to the pages and was not found onboard, the captain alerted the local authorities of the situation. Our care team is providing support to the guest’s family and our thoughts and prayers are with them.”

Another passenger saw the man go overboard at 7:10am EST and raised the alarm. The Mexican navy and coastguard have taken over the search while the Allure continued on its journey.

The man’s family has been notified but his name has not been released to the press. Queerty will revisit the story as more information becomes available.

New Jersey’s Republican governor Chris Christie clarified his position on the state’s new gay-marriage bill today, stating that if it gets to his desk he will indeed veto it. This came just hours before the bill was approved in a Senate committee 8-4 and sent to the full Senate for a vote next week.

While discussing the issue in Bridgewater, NJ, Christie urged lawmakers to put the marriage issue to voters in November. ”Let’s put the question of same-sex marriage on the ballot,” Christie said. “It shouldn’t be decided by 121 people in Trenton.”

That way no one suffers any political backlash. Right, Mr. Christie?

If marriage equality does go to a public vote, though, it might have a good chance of winning. According to a Quinnipiac Poll out last week, a majority (52%) of New Jersey residents support marriage equality. Of course, polling numbers and voting numbers often vary wildly when it comes to the touchy subject of same-sex marriage, as witnessed in California’s Prop 8 disaster. So gays in the Garden State might remain in legislative limbo for some time to come.

The story goes that at least ten customers were sold clay iPads over the holidays from Canadian electronic stores. These customers were sold what appeared to be sealed iPad 2s, but turned out to contain slabs of clay rather than, you know, iPad 2s. Best Buy and Future Shop of Canada opened investigations, but since the stores already compensated the customers, we’re in the clear to laugh at the situation a bit.

This scam is a lot less scandalous than the iPad McDonalds story. In that case a lady went against every shred of common sense and purchased what she thought was an iPad from a pair of men in a McDonald’s parking lot. It turned out to be wooden block. But this time, the buyers purchased sealed boxes from reputable retailers. They had no idea that a slab of clay was inside the box.

The popular theory right now is that scammer purchased the iPads and replaced the units with a block of clay weighing the same as the iPad. The person than re-wrapped the iPad in retail-grade cellophane and returned it to the store as an unopened item, effectively circumventing any return policy. The scammer likely had to employ a bit of social engineering too as most stores log the customer’s ID on large returns. From there, the retailers simply returned the units to the shelves to be sold to unsuspecting customers.

Of course once these customers started showing up at the retailers, the stores responded with suspicion and bewilderment. At first the customers were turned away with the stores claiming they were the scammers. But after a bit of persisting, the stores recanted and refunded the purchase amount, and at least in one case, also gave the customer a free tablet to compensate for the hassle.

Returning a brick in a box is one of the oldest scams. If that box gets placed back on the store’s shelves, the customer will lose nearly every time. Consumers have no protection against it aside from opening the box right in front of the cashier. I mean, most will not buy an iPad from guys in a McDonald’s parking lot. That’s just straight up dumb. Buying an iPad from a major retailer shouldn’t throw up the same warning flags.

So here’s what you do: Skip the iPad and buy a Playbook or Xoom 2 next time. No one is going to go the trouble of putting a brick in Playbook box.

Nineteen-year-old gay filmmaker Eric James Borges, who often went by EricJames online, committed suicide yesterday, a month after recording an “It Gets Better” video and seemingly finding support in the gay community.

Word began spreading late Wednesday among shocked and saddened friends and acquaintances. Not accepted by his birth family, EricJames was striking out on his own, trying to deal with his personal situation, but also wanting to help others. Sadly, even involvement with the Trevor Project was not enough to help him navigate the turbulent waters of young adulthood.

I met EricJames recently, at the launching of My LGBT Plus, a youth oriented resource site, based in Fresno, California. A brief introduction left me with the impression of a fine young man, and I regret that I did not get to know him better.

Throughout the Central Valley we remember the life of Eric James Borges, 19, of Visalia, California. I first met Eric at the Reel Pride Film Festival where he helped with The Trevor Project booth at the Youth Pizza Party and again when he came to support My Lgbt Plus at our unveil in November. Not only was he a very kind and talented individual, you could see that he had a passion in his eyes to do something great. I wish I had more time to get to know you Eric – your LGBTQ family we will always love and miss you.

David Dean Smith from Comstock Park, Mich., a suburb of Grand Rapids, allegedly infected 3,000 men and woman with HIV — on purpose, MSNBC reported.

Smith, 51, recently turned himself into Michigan police and claimed that he slept with thousands of people over a number of years with the intent of killing them by infecting them with the virus. Health officials from the Kent County Health Department have issued a warning that “hundreds of people have been exposed to HIV,” and recommend people to get tested for the virus.

Despite his claims that he has infected thousands, Smith has only been arraigned and charged with two counts of “AIDS-sexual penetration with an uninformed partner.” Smith is currently in Kent County Jail with a $100,000 bond.

One of the two possible victims told a local Grand Rapids news station, WOOD-TV, that she has been HIV positive since Oct. 2008.

She met Smith through a personals ad on Yahoo! and says she instantly knew it was Smith who infected her. She also said that he sent her a text message informing her that he was turning himself over to police, that “his life is over” and that he will always love her.

“It’s something he should have done years ago,” she said. “He shouldn’t get a pat on the head for what he did.”

She also believes that Smith has infected several others as he told her that he had sex with 3,000 men and women.

“He hits drifters,” she said. “He hits people who are young. He hits young women, and from what I understand, he hits men, too. Those are his targets.”

At his arraignment, Smith said he was receiving mental help and was hospitalized for trying to commit suicide. The hospital’s records indicate that Smith is “sexually aroused by causing pain to females.”

Richard E. Zambon, Smith’s attorney, told MSNBC that he worried about Smith’s mental health but will “explore all options” when defending him in court.

In a similar case, Nushwan Williams admitted in 1997 to having unprotected sex with up to 47 women in Chautauqua County, which lies along the New York-Pennsylvania boarder, and 28 women in New York City. Williams slept with them even though he knew about his HIV positive status.

In a more notorious case, Gaetan Dugas, who was Canadian air flight attendant and the alleged patient zero for AIDS, spread the disease to several victims before it was fully understood.

Dugas claimed to have slept with more than 2,500 people across North America since 1972.

There are many laws that specifically target HIV-positive individuals and several advocacy groups, along with Rep. Barbra Lee (D) from California, that want to repeal these laws and say they are unjust, the Associated Press reported in a Jan. 3 article.

The article points out that there is currently a man serving an HIV-positive, 35-year prison sentence for spitting at a police officer and a man infected with the virus who allegedly bit a neighbor during a fight and faced a bioterrorism charge.

EDGE reported in an April 2010, of several incidents where HIV was treated as a deadly weapon. Darren Chiacchia, who won a bronze metal for the U.S. equestrian team in the 2004 Olympics, was brought to court for not telling his then boyfriend he was infected with the virus. He faced a 30-year prison sentence but all charges were dropped.

In addition, a man in Texas was accused of having sex with an underage boy and was charged with aggravated sexual assault with a deadly weapon because he is HIV positive.

Rick Santorum continued his string of antigay pronouncements while on the trail in New Hampshire, saying a man in jail would be a better parent than a same-sex couple.

The Los Angeles Times reports from Manchester, New Hampshire that Santorum claimed to quote an anti-poverty expert while explaining his case.

“He found that even fathers in jail who had abandoned their kids were still better than no father at all to have in their children’s lives,” Santorum told voters about the researcher, according to the Times.

If a same-sex couple were to raise a child, they would be “robbing children of something they need, they deserve, they have a right to. You may rationalize that that isn’t true, but in your own life and in your own heart, you know it’s true.”

This isn’t a new theme for Santorum and it potentially sets him apart from other Republican candidates for president. While in Iowa, where he finished behind Mitt Romney by eight votes, Santorum signed a pledge from the Iowa Family Leader that proclaimed his belief that same-sex parents are inferior to straight ones. Romney and Ron Paul did not sign the pledge, and Newt Gingrich inexplicably ignored that portion in his letter to the group backing only parts of it. (Gingrich’s lesbian step-sister, Candace Gingrich-Jones, toldThe Advocate in December that she and her wife would like to have children.)

A study released today says 48% of gay men would sacrifice a year or more of their lives in exchange for a perfect body.

The research also said 10% of gay men would agree to die more than 11 years earlier if they could have their ideal body now.

Nine in ten gay men admit they enforce “unrealistic” images of lean and muscular men in conversation.

In comparison, only a third of straight men said they would give a year or more for an ideal body shape, and 77% admitted buying into the body image ideal.

The research was part of a study commissioned by Central YMCA, the Succeed Foundation and the Centre for Appearance Research at UWE Bristol into how men talk about their bodies.

Gay respondents were consistently more affected by body concerns and more likely to make body comparisons than straight men.

They were also significantly more likely to use what the study authors called “body talk”: speech that implicitly or explicitly reinforces or endorses the traditional western standard of male attractiveness: tall, lean, muscular, toned body with clear skin and a full head of hair.

91.2% of gays said they make statements which reinforce this image, compared with the 77.4% of straight men.

Nearly twice as many gay men as straight, 59% to 32%, said they compare themselves to better-looking men.

A third of gay men said they compared themselves with men they thought were less attractive, compared with 20% of straight men.

Rosi Prescott, CEO of Central YMCA, told PinkNews.co.uk: “This research shows that body image anxiety is sadly much more of an issue for gay men.

“Today gay men are under enormous pressure about their bodies, and we believe that a lack of body diversity in the media, including the gay press, and a relentless focus which values people based on appearance, may in part explain why gay men are particularly susceptible to this issue.

“This is of concern when we know that record numbers of men are taking steroids or having unnecessary cosmetic surgery to achieve what is often an unattainable or unrealistic body image ideal. Central YMCA is campaigning to promote greater body diversity in the media, and for young people to be given an opportunity to learn more about body image in schools.”

Straight men came out narrowly ahead of gays when rating how they important they thought their body was to their partner.

51.4% of straight men said what their partner thought of their shape and weight was “very or extremely important” to them, compared with 49.4% of men.

But only 20% of straight men said their friends’ opinions were that important, versus 35% of gay men.

Dr Phillippa Diedrichs, who conducted the study at UWE Bristol, said, “This research really demonstrates that body image is an issue for everyone, and that we need to take a collaborative approach towards promoting an environment that values diversity in appearance and promotes healthy body image.”

With those words, Los Angeles County Supervisor Zev Yaroslavsky announced the end of nearly 100 hours of horror inflicted upon his constituents with the capture and charging of the LA and WeHo “carsonist.”

The alleged arsonist whose four-day reign of terror caused over $3 million in damage, destroyed hundreds of cars, burned dozens of structures and disrupted thousands of lives will face a federal judge in Van Nuys tomorrow on at least one felony charge of arson.

Harry Burkhart, the 24-year old German national apparently seething over his mother’s impending deportation, was arrested early yesterday morning after allegedly setting another 11 arson fires – two in West Hollywood – when a volunteer reserve Deputy Sheriff spotted his van on Sunset Boulevard just blocks from his apartment.

After pulling Mr. Burkhart over, LAPD officers spotted charcoal fire starters in his van.

In all, Mr. Burkhart is suspected of setting 53-55 fires between early Friday morning and early Monday morning .

No arson fires were reported overnight.

In a press conference last night, law enforcement and elected officials thanked the media for its coverage that provided the tip leading to Mr. Burkhart.

Mayor John Duran lauded the work of law enforcement, calling the experience a trial run of the area’s domestic counter-terrorism capabilities.

“We had a test run of what happens when we have a form of domestic terrorism amidst us. We had a test run that didn’t involve a loss of life, but we saw what worked.

“People watching out for one another, banging on each other’s doors, law enforcement working together, people who have pets escape going out to retrieve their neighbors’ pets, younger people taking care of older tenants in their building,” he said.

“We he a test run, amidst this urban evil, of what is goodness there is… when we were terrorized for four straight nights.”

Authorities said little about Mr. Burkhart’s motives, but acknowledged that the tipster came in the form of a federal immigration official who witnessed Mr. Burkhart’s violent reaction to his mother’s recent deportation hearing.

According to the LA Times, the State Department official told investigators that Mr. Burkhart “had attended a recent immigration hearing regarding his mother’s case and erupted in a tirade, spewing angry anti-American statements.”

The Times quoted a “senior LAPD official” who said Los Angeles detectives “were also investigating reports that either Burkhart or a family member was connected to an arson case in Germany.”

Thom Mrozek, a spokesman for the U.S. attorney’s office said today that Mr. Burkhart’s mother, Dorothee Burkhart is in federal custody in Los Angeles after Germany requested her detention on an arrest warrant.

Apparently Ms. Burkhart is wanted on fraud charges related to commercial leases and a breast augmentation she failedto pay for in Germany.

She appeared at a deportation hearing today, and sources in the courtroom say she expressed concern for her son, who she said “is mentally ill.”

Neighbors at Mr. Burkhart’s apartment building above a Sunset Boulevard and Fuller hair salon (a stone’s throw outside WeHo) described Mr. Burkhart as “scary,” and standoffish, never responding to greetings and scurrying away from encounters.

The Times is reporting that a neighbor, Galina Illarionova, said the suspect pounded on her door Sunday claiming to have legal problems for which he wanted her help, but that he later changed his mind.

The hero of the day turned out to be a vigilant volunteer Deputy Sheriff who works for $1 a year, Shervin Lalezary, a Beverly Hills attorney by day.

Mayor Duran promised the reservist, a Teheran, Iran, native, “the best dinner on the Sunset Strip,” in thanks for his alertness.

Recently beset upon by jail oversight issues, LA County Sheriff Lee Baca took a small victory lap, saying, “I’m ecstatic that law enforcement gets to shine a little bit.”

Now the investigation goes into high gear, say lead investigators.

“There’s so much more work to be done,” said LAPD Commander Andrew Smith.

He described a target-rich environment of evidence, including fires that failed to ignite and results of a search warrant served at the suspect’s home.

“We’ve got a bunch of clues, a bunch of leads, more people to interview, search warrants to execute. Our guys will be working around the clock. They’ll be working for many days on this case,” said Commander Smith.

The accused is in jail awaiting his arraignment; while he waits, the investigators are hoping to provide evidence enough of other arson fires to boost that single count past four dozen.

At the press conference, LAPD Chief Charlie Beck said, “As we speak, search warrants are being served at this individual’s residence. “We will know much more tomorrow than we know today. We have to proceed with caution,” in compiling evidence to present the case to the District Attorney for formal charges to be filed.

Mr. Burkhart’s bail was set at $250,000, according to jail records.
